Whose at fault for the accident

A consumer contacted our office after their insurer assigned them 50% responsibility for an accident, despite their belief that they were not at fault. The third party involved provided a conflicting account, placing full responsibility on the consumer, which led the insurer to initially determine shared fault.

After the consumer submitted photographs and additional evidence to our office, we contacted the insurer and requested a further review of the claim. Based on the information provided, we were of the opinion that the consumer was likely not at fault.

Following a reassessment, the insurer agreed with this conclusion and revised their decision, ultimately assigning 0% liability to their insured. Avoiding an at-fault designation was significant, as such a finding could have led to an increase in the consumer’s insurance premiums.
