Sometimes a coverage decision deserves a closer look

One consumer contacted our office after being required to pay a deductible on a claim where another party was clearly responsible for the damage. The insurer had taken the position that Direct Compensation for Property Damage (DCPD) did not apply because commercial equipment was involved. After reviewing the applicable legislation, we raised our concerns with the insurer and explained why the criteria for DCPD appeared to be met. The insurer promptly reviewed the matter, reversed its position, and refunded the consumer's deductible in full. This case highlights the importance of understanding your coverage and questioning decisions that may not be consistent with the facts of the loss.
