Record Corrected

An insurer had determined that its insured was responsible for a motor vehicle accident without notifying her of that decision.

Several years later, when she decided to switch insurance providers, she was informed that the accident appeared on her driving record and that, as a result, her insurance premiums would be higher.

She immediately took steps to have her record corrected, but her efforts were unsuccessful. She then turned to our office for assistance.

After hearing her account and reviewing the legislation and regulations applicable to her situation, we contacted her former insurer to point out the error. Based on the Fault Determination Rules, we were convinced that she should not have been held responsible for the accident.

Following several discussions and exchanges with the insurer, the company ultimately accepted our recommendation and overturned its original decision. Her record was accordingly corrected.
