Privacy Breach

An insured contacted our office regarding the disclosure of personal information by his insurer. Following a motor vehicle accident, the insurer provided the at-fault party’s insurer not only with the insured’s name, but also his home address, telephone number, and other personal details.


The other party subsequently used this information to harass the policyholder, to the point that police intervention became necessary.


The client questioned the extent of the information disclosed during the claims process, and we agreed that it did not appear necessary to share such a broad range of personal information for the purpose of handling the claim. Ultimately, the insurer reached a settlement with the client that was satisfactory to him.


It is worth noting that if you believe your insurer has disclosed your personal information without proper authorization, beyond what is permitted by applicable privacy laws or by any consent you may have provided, you have the right to file a formal complaint with the Office of the Privacy Commissioner of Canada.
