Insurer reverses course several times but a binding settlement is binding

After an accident, a consumer was told her vehicle was a total loss. The insurer made a written settlement offer, which the consumer accepted in writing. The claim appeared settled.

Then, unexpectedly, the insurer withdrew its offer and announced it would repair the vehicle instead.

Frustrated by the sudden reversal, the consumer challenged the decision. The insurer then changed course again, proposing a different settlement amount. Confused and concerned by the inconsistent claims handling, the consumer contacted our office.

After reviewing the written correspondence and accepted settlement offer, we reached out to the insurer. Following our intervention, the insurer honored the original agreement and paid the settlement as promised.
