Agony of collision

An insured was initially deemed at fault by his insurer after being placed in an unavoidable emergency situation caused by an oncoming motorist. Although no physical contact occurred between the vehicles, he was forced to take evasive action to avoid a collision, resulting in his vehicle leaving the roadway and striking an electrical pole.

We successfully challenged the insurer’s liability determination, leading to a reversal of fault and reimbursement of the consumer’s deductible.
